1. Understanding This Privacy Policy

 

LifeWritr (also referred to as “Operator”) operates the LifeWritr website (also referred to below as the “Site” or “Website”), which provides life planning service and more, hereinafter referred to collectively as the “Service(s)”.

This Privacy Policy is effective as of June 7, 2018, and will remain in effect except with respect to any of its provisions that are changed in the future, in which case the changes will become effective on the date they are posted on the website or we otherwise notify you of the changes. We reserve the right to change this privacy policy at any time. Changes, modifications, additions, or deletions will be effective immediately on their posting to this site. You should check this policy periodically as its terms may change from time to time. Your continued use of the site after we post any such modifications will constitute your acknowledgment of the modified policy and your agreement to abide and be bound by the modified policy. We will also revise the “last updated” date found at the beginning of this privacy policy when we post changes to it.

We will not use or share your personal or general information with anyone except as described in this Privacy Policy. However, we will release personal or general information without your consent for security purposes, when required by law, or to prevent imminent harm to any person or entity. We will disclose personal or general information upon receipt of a court order or subpoena, or to cooperate with a law enforcement investigation, which may include responding to requests and court orders from jurisdictions outside the United States. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful, as determined in our sole discretion. Release of your personal data for security purposes, as described in this agreement to any person or entity under any circumstances shall be based on a determination made solely by us, exercising our own discretion, permission for which is expressly granted by you to us in accordance with this policy.

The terms used in this Privacy Policy have the same meanings as in our Terms of Service, unless otherwise defined in this Privacy Policy.

The privacy policy does not extend to anything that is inherent in the operation of the Internet, and therefore beyond Operator’s control, and is not to be applied in any manner contrary to applicable law or governmental regulation. This online privacy policy only applies to information collected through this site. This privacy policy does not apply to any information we may collect from you in any place other than this website.

 

2. Who Can Use Our Website

 

All activities in which you may engage on this website are voluntary. You are not required to provide any personal information to us unless you choose to access features on this site which require the information. If you do not agree with the terms of this policy or other terms of use on this website, then you should immediately exit this website and discontinue using the Site. If you do not agree with the terms of our Privacy Policy and our Terms of Service, please do not provide us with personal information, and leave this website. The terms of use of this site are expressly incorporated herein by reference and made a part of this policy. By using LifeWritr’s Website, you signify that you agree to the terms of this privacy policy as well as to our terms of use.

LifeWritr intends only persons who are 18 years or older to use this website. Personal registration information submitted by a person under the age of 18 will not be accepted. Any general information provided by a person under the age of 18 and gathered (for example, through the use of cookies) during his or her visit may be used as indicated in this policy (see Section 5). LifeWritr is committed to protecting the privacy of children and has no intention of collecting personal data from children under the age of 18. We encourage parents and guardians of children under 18 to regularly check and monitor their children’s use of e-mail and other activities online.

LifeWritr does not provide Services to people within the European Union at this time. By using our Services, you are representing that you are not accessing the Site from within the European Union.

This Privacy Policy discloses the privacy practices for LifeWritr and our Services. This Privacy Policy applies solely to information collected by this Website, except where stated otherwise. It will notify you, among other things, of the following:

  • With whom it is shared;
  • How it can be corrected;
  • How it is secured;
  • How policy changes will be communicated;
  • How to address concerns over misuse of personal data; and

LifeWritr automatically tracks and collects the following categories of information when you visit our Site: (1) IP addresses; (2) domain servers; (3) types of computers accessing the Site; and (4) types of web browsers used to access the Site (collectively “Traffic Data”). Traffic Data is anonymous information that does not personally identify you but is helpful for marketing purposes or for improving your experience on the Site. This Traffic Data, collected from your browser, may include information such as your computer’s Internet Protocol (“IP”) address, browser version, pages of our Service that you visit, the time and date of your visit, the time spent on those pages, and other statistics.We use Traffic Data for things such as traffic analysis or e-commerce analysis of our website, and to determine which features of our site are most or least effective or useful to you. LifeWritr is strongly committed to not sharing nonpublic information with third parties. Above all, LifeWritr does not sell, rent, or in any way share any of the personal information included in your Preserve Your Legacy forms or any letters you write on this site with third parties. The only exception to this is when it is required to comply with the law as discussed in Section 1.

This being said, under this Privacy Policy, we may share your information only under particular situations, as described in this Policy. As non-exclusive examples, we use Contact Data to send you information about our company or our products or services, or promotional material from some of our partners, or to contact you when necessary. We use your Financial Data to verify your qualifications for certain products or services and to bill you for products and services. We use your Demographic Data to customize and tailor your experience on the Site, displaying content that we think you might be interested in and according to your preferences.

We are the sole owners of the information collected on this site. We only have access to/collect information that you voluntarily give us via email or other direct contact from you. We will not sell or rent this information to anyone.

Our Website includes the ability to make information public. We are not responsible for how you choose to share your own information and you acknowledge that any information you publish in these forums becomes public information. Other than to the companies belonging to LifeWritr for the purposes set out above, and except as described in this policy, we do not sell, trade, or otherwise transfer your personal information or general information to third parties without informing you in advance. We provide some of our services through contractual arrangements with affiliates, services providers, partners and other third parties (collectively, “service partners”). LifeWritr may employ third-party companies and individuals due to the following reasons:

  • To provide the Service on our behalf;
  • To perform Service-related services; or
  • To assist us in analyzing how our Service is used.

We want to inform our Service users that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose. We will encourage our service partners to adopt and post privacy policies. In such an event, you can still access and use much of the Site; however you will not be able to access and use those portions of the Site that require your Personal Information. If you do not wish to receive information and promotional material from us or from some of our partners, you may contact us to opt out at info@lifewritr.com. You may also cancel your registration through your account settings and choose to have all your personal information deleted from our database at any time, once again by contacting us at info@lifewritr.com.

You may also update your Personal Information at any time to ensure it remains correct and up-to-date. This may be done through your personal profile, Through your personal profile you may review and update your Personal Information that we have already collected. We encourage you to keep your Personal Information as up to date as possible.

You must promptly notify us if your credit card, user name, or password is lost, stolen, or used without permission. In such an event, we will remove that credit card number, user name, or password from your account and update our records accordingly.

Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over, and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

This includes links from partners that may use LifeWritr’s logos as part of a co-branding agreement. The sites those links can take you to once again have their own separate privacy policy and although we seek to protect the integrity of our site, Lifewritr is not liable for the content and activities of those sites. Your visits and access to such websites is at your own risk. Please note that those other sites may send their own cookies to users, collect data, or solicit personal information.

 

11. How We Handle Surveys and Contests

 

From time-to-time our Site requests information via surveys or contests. Participation in these surveys or contests is completely voluntary and you may choose whether or not to participate and therefore disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, age level). Contact information will be used to notify the winners and award prizes. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this site.

 

12. Children’s Privacy

 

It against our Terms of Service to use this site if you are under 18 years of age and we do not direct any of our content specifically at children under 13 years of age. We understand and are committed to respecting the sensitive nature of children’s privacy online. If we learn or have reason to suspect that a site user is under age 13, we will promptly delete any personal information in that user’s account.

In the case we discover that a child under 13 has provided us with personal information, we immediately delete this from our servers. Under California’s “Shine the Light” law, California residents who provide personal information in obtaining products or services for personal, family, or household use are entitled to request and obtain from us, once each calendar year, information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately preceding calendar year.

To obtain this information, please send an e-mail message to info@lifewritr.com with “Request for California Privacy Information” in the subject line and in the body of your message. We will provide in response the requested information to you at your e-mail address.

Please be aware that not all information sharing is covered by the “Shine the Light” requirements and only required information will be included in our response.

 

14. Browser “Do Not Track” Requests

 

This Site treats the privacy of all users with an equally high level of respect and priority. Thus, as all users and user information is treated the same, this Site does not acknowledge your browser’s “Do Not Track” requests.
